GENERAL CONDITIONS OF SALES

Article 1. Scope of the General Terms and Conditions of Sale
The present general conditions and/or the reservation contract sent to the Client form a contractual whole and constitute the entirety of the contractual relations between the Camping and its Clients.

This set governs the sale of stays by the Campsite and is valid at the time the order is placed to the exclusion of all other conditions.

The Campsite reserves the right to modify its general conditions at any time. However, the version applicable to the Client is the one that he/she will have accepted at the time of the reservation.

Article 2. Acceptance of the General Conditions of Sale

The Client is deemed to accept these General Terms and Conditions of Sale without reservation, in accordance with the provisions of Article 1126 of the Civil Code. The Client is therefore well informed that, by ticking the box I certify that I have read the General Terms and Conditions of Sale when placing an order on the internet or by receiving the reservation contract to which these conditions are attached, he/she is expressing his/her specific, free and informed consent, in particular as regards the use of personal data. This unreserved acceptance is valid for both the Client and any person participating in the holiday. The present General Terms and Conditions of Sale are also available on the campsite's website and at the campsite's Reception.


Article 3. Reservation

3.1 Booking conditions

Method of reservation - The Client may make a reservation online, by telephone or at the campsite.

Validation of the reservation - Any request for a reservation is considered as a definite reservation from the moment it is accepted by the Campsite. The campsite is free to refuse the request depending on availability or any other circumstance that could affect the planned stay.

The acceptance of the reservation is only materialized by the sending of a confirmation of reservation by mail, e-mail or by hand delivery.

In order for a reservation to be validated, it must also be accompanied by a payment including

- A deposit of 30% to 100% of the total amount of the stay depending on the date of booking.

Electronic signature applicable to online sales - The provision of the client's credit card number online and the final validation of the order shall be deemed proof of the client's agreement to the payment of the sums due in respect of the reservation and the signature and express acceptance of all operations carried out.

Capacity and participants in the stay - The reservation is nominative. The Client must be over 18 years of age, participate in the reserved stay and legally provide the names, surnames and dates of birth of all participants, including minors and newborns. The Campsite reserves the right to refuse any person not registered at the time of booking. Any incorrect information may result in the cancellation of the stay. Because of the personal nature of the reservation, it cannot be transferred or sublet in whole or in part without the prior written agreement of the campsite. For safety and insurance reasons, the maximum number of occupants per type of accommodation/site, as described in the brochure and on the website, must be respected. The Campsite will not accept any person beyond this capacity (including newborns) with the exception of any visitors invited by the Client for the day.

Group - The campsite offers family-oriented stays, the accommodation being specially designed for this purpose. The Campsite reserves the right to refuse any booking that does not correspond to the capacity of the accommodation offered.

The Campsite considers that any reservation(s) of 2 or more rental accommodations / pitches made by the same natural person or by different natural persons who know each other and are travelling together for the same reasons, on the same dates and on the same Campsite is a group. All requests for group bookings must be sent by e-mail to contact@lebardou.com, or by telephone to 04.75.37.71.91 (price of a local call depending on your operator), specifying that it is a group booking request. The campsite reserves the right to examine the request before accepting or refusing it.



3.2 Important information

Minors - For obvious reasons of safety (swimming pool, evacuation of the campsite in case of alarm...) and health (hospitalisation...), minors not accompanied by their legal guardians, as defined in article 389 of the Civil Code, are not admitted. Furthermore, the Campsite is not authorised, in the sense of decree 2002-883 of 3 May 2002, to provide group or individual stays outside the family home for minors under 18 years of age, unaccompanied by one of their legal guardians. Minors accompanied by their legal guardians are placed under the sole responsibility of the latter and must not be left unsupervised on the campsite premises (including the swimming pool) under any circumstances.

Non-contractual nature of communication media - Any document other than the present General Terms and Conditions of Sale and in particular, catalogues, leaflets, advertisements and notices are for information purposes only and are not contractually binding. The plans and photos of the rental accommodation are given for illustrative purposes only. The layout and characteristics of the rooms may vary from one model to another. It is advisable to refer to the written description of the accommodation available on the accommodation section of the campsite's internet page in order to know the exact composition of each rental accommodation. A description is also available inside each rental accommodation. If you have any questions, our reservation centre is at your disposal on 04.75.37.71.91 (price of a local call according to your operator).

Facilities and activities of the campsite - It may happen that some activities and facilities offered by the campsite (directly or through service providers) such as wifi or elements of the swimming pool, listed in the description, are removed, particularly for climatic reasons or in cases of force majeure, or do not work, particularly before and after the season. The campsite cannot be held responsible. The Campsite will inform the Client of any works / hazards / developments undertaken during the stay.



Article 4. Prices

The applicable prices are those indicated at the time of booking by telephone, on the internet or on the campsite. They are subject to change during the season and are in euros including VAT.

Any subsequent change in the applicable VAT rate, occurring between the time the rates were determined and the invoicing of the stay, will result in a proportional change in the price including VAT, which the Client accepts without reservation.

The price includes :

- The rental of the pitch or the equipped rental accommodation as defined in the brochure and on the websites;

- The consumption of water, gas and electricity;

- Access to the campsite, its facilities and activities (except list below) as defined in the brochure and websites;

- The pitch for one car per rental (the pitch is not necessarily on the rented pitch).

The price does not include :

- The various taxes;

- The paying activities proposed by the campsite to be paid on the spot;

- The guarantee deposits (deposit);

- The guarantee of a specific pitch;

- Optional equipment.



Article 5. Terms and conditions of payment

5.1. Terms of payment

The full price of the stay is payable :

- 30 days before the beginning of the stay;

- Or immediately for any reservation made less than 30 days before the start of the stay.

In the absence of full payment on the agreed date, the Campsite is entitled to consider that the Client has cancelled the reservation and will retain any sums already paid.


5.2. Methods of payment

The methods of payment of the deposit and/or the total amount of the stay accepted by the Campsite vary according to the date of payment:

- If the payment is made at least 30 days before the date of arrival: it can be made by credit card, bank transfer, holiday vouchers (sent by registered post with acknowledgement of receipt) and by cheque in euros (sent by registered post with acknowledgement of receipt).

- If payment is made between 29 and 15 days before the arrival date: payment can be made by credit card and bank transfer.

- If payment is made between 14 days and the day before arrival: only credit cards are accepted.

- For any payment on site: the customer can pay the balance by credit card, cash and holiday vouchers. Cheques are not accepted on the campsite.



5.3. Details of payment by credit card

Credit cards accepted are those of the Carte Bleue, Visa, Eurocard/Mastercard networks.) American Express is not accepted. The transaction is immediately debited from the Customer's bank card after verification of the card details. In accordance with article L.132-2 of the French Monetary and Financial Code, the commitment to pay by means of a payment card is irrevocable. By communicating his/her credit card details either online or by telephone, the Client authorises the Campsite to debit his/her credit card for the amount of the deposit or the entire stay. To this end, the Customer confirms that he/she is the holder of the credit card to be debited and that the name on his/her credit card is indeed his/her own. In the event of fraudulent use of the bank card, the Client is invited, as soon as this use is noted, to contact our reservation centre on 04.75.37.71.91 (price of a local call depending on your operator).


Article 6. Services not included in the price

6.1. Tourist tax

The tourist tax is collected on behalf of the municipalities and must be paid. The amount per person and per day varies according to the destination and may be modified during the year.



6.2 Paid activities offered by the campsite to be paid on site

Some activities offered by the Campsite or one of its service providers are optional and chargeable. It is specified that access to the campsite swimming pool is not a paying activity. If you have any questions, our reservation centre is at your disposal on 04.74.37.71.91 (price of a local call depending on your operator).


6.3. The security deposit (deposit)

For all stays at the campsite, a deposit of 100€ for pitches and 200€ or 300€ for rental accommodation will be requested at the latest on the day of arrival at the campsite. The deposit can be paid by credit card or cheque. The deposit will be returned in its entirety on the day of departure or within two weeks at the latest, after a check of the cleaning and a satisfactory state of the equipment. If this is not the case, the deposit will be deducted in full. Damage exceeding the amount paid as a security deposit will be charged to the Client after deduction of the security deposit. In the event of a cash deposit and if the Client wishes to have the amount returned immediately after his departure, it is up to him to make an appointment at the latest the day before his departure in order to carry out an inventory of fixtures of his accommodation.



6.4. Guarantee of a specific pitch

Pitches are allocated by the Campsite according to availability, in order to optimise planning. This allocation can be changed at any time before the keys are handed over. Only the location, dates and type of accommodation are guaranteed.



6.8. Optional facilities

The campsite offers optional equipment such as refrigerator, bed linen, towels, barbecue, etc. Some of these are included. This equipment is provided on request and subject to availability. Article 7. Partner benefits and promotional offers

Promotional offers are subject to certain conditions and cannot be combined unless otherwise stated. Partner benefits and promotional offers cannot be applied to a booking that has already been paid for in full or in part. On these occasions, customers may have paid different prices for the same stay. Customers who have paid the higher price will not be entitled to a refund of the difference between the price they have paid and the promotional price. In order to benefit from a partner advantage, the Customer must justify the benefit of the said advantage in accordance with the provisions agreed with the service provider. The holders of partner benefits must be holders of the holiday. The Campsite will check the applicability of the offer. In the event of fraud, the amount of the discount will be claimed from the Customer.



Article 8. Withdrawal

The Customer is informed that, pursuant to Article L. 121-20-4 of the Consumer Code, the sale of accommodation services provided on a specific date or at a specific time is not subject to the provisions relating to the withdrawal period applicable to distance selling. No right of withdrawal therefore applies to the sale of holidays by the Campsite.


Article 9. Modification of the reservation/stay

Any request for modification must be made at least 10 days before the start of the stay. It is up to the Client to make the request to the Campsite by registered mail with acknowledgement of receipt to the address of the Campsite or by sending an email to the following address contact@lebardou.com. The Campsite will do its utmost to comply with the request according to availability and applicable rates. If the change is not possible or accepted, the Client must make the stay as originally planned or cancel it.


Article 10. Cancellation of the stay (not covered by the cancellation/interruption insurance)

10.1. Cancellation by the Campsite

Except in cases of force majeure, the stay will be fully refunded. This cancellation cannot, under any circumstances, give rise to the payment of damages and interest.



10.2. Total or partial cancellation by the Client

It is up to the Client to notify the Campsite by registered mail with acknowledgement of receipt to the address of the Campsite or by sending an e-mail with acknowledgement of receipt to the following address contact@lebardou.com.

The date of receipt of the cancellation will determine the possible cancellation fees.

In the absence of any written notice in the above-mentioned conditions, the Client will be required to pay the full amount due for the reservation.

The scale of cancellation charges applicable is as follows:

- Before the 61st day inclusive before the stay: 10% of the total amount of the rental plus any additional costs (administrative costs, insurance, etc.) will be charged.

- Between the 60th and the 31st day before the stay: 30% of the total amount of the rental as well as the additional costs (file costs, insurance, etc.) will be charged.

- Between the 30th and 16th day before the stay: 50% of the total amount of the rental plus the additional costs (administrative costs, insurance, etc.) will be charged.

- Less than 15 days before the stay or in case of no-show: the total amount due for the reservation will be invoiced.

It is clearly stated that whatever the date of cancellation.



10.3. Total or partial cancellation by COVID

For all stays booked during the 2022 season, you may cancel or modify** your stay up to 1 day before your arrival, for a reason linked to Covid-19*. You will be offered either a refund or a non-refundable voucher valid for 18 months from the date of issue. These provisions are in addition to our current GTC.

* The campsite has to close, your place of residence is confined, border closure due to Covid-19, one of the participants has Covid-19 at the time of departure.

** subject to availability of accommodation at the time of cancellation



Article 11. Course of the stay

11.1 Arrival and departure times

In bare camping pitches - Arrivals are from 12 am and departures before 10 am.

For rented accommodation - Accommodation is available from 4pm and must be vacated by 10am at the latest on the day of departure.

In the event that a Client is unable to respect the arrival times, it is their responsibility to contact Reception immediately to try and find a solution. In case of no-show within 24 hours of the scheduled arrival date and without a written notice sent to the Campsite giving a definite date, the Campsite reserves the right to put the accommodation / pitch up for sale.

No refund or compensation will be made. No reduction will be made in case of late arrival or early departure.

In the event of a delay in handing over the keys / releasing the pitch, an additional night will be charged.



11.2 Duration of stay

In camping pitches - During the high season*, minimum stay of 7 nights depending on availability. During the low season*, minimum duration of 1 night or 3 nights for the Ascension/Whitsun weekend, depending on availability.

In rented accommodation - During high season*, minimum stay of 7 nights according to availability. During the low season*, minimum stay of 2 nights or 3 nights on Ascension/Whitsun weekend depending on availability.


11.3 Check-in / Check-out

Check-in - On arrival, Reception checks the Client's balance. The Client must have paid the balance in full, present an official and valid identity document and deposit the security deposit in accordance with the conditions set out above. After registering the Client's arrival, Reception will give the Client the keys to the rental accommodation, any access card to the campsite, and the regulatory information. It is the Client's responsibility to check the inventory upon arrival and to report any non-conformity within the day of arrival.

Check-out - It is the Client's responsibility to return the accommodation in a clean and tidy condition before 10am. If this is not the case, a fee for cleaning up the property, which corresponds to the amount of the cleaning fee, may be charged. Similarly, any object broken, lost or damaged during the stay may be charged to the Client. The security deposit will be returned in accordance with the conditions set out above.



11.4 House rules

During the stay, the Client undertakes to respect the campsite's internal regulations, which are available / displayed at the reception and on the campsite's website. These rules are applicable to all persons residing with him or under his responsibility.

Unless otherwise stated in the campsite's internal regulations or expressly authorised by the campsite, the installation of a tent is prohibited on the pitches for rental accommodation.

In the event of obvious non-compliance with these rules, the Director of the site may impose sanctions that may go as far as the termination of the contract, especially in the event of disruptive behaviour contrary to the calm and serenity of the reception or in the event of violent behaviour, abusive, racist or threatening remarks made against other Customers, the Campsite's staff or its partners or suppliers. The Client is informed that access to the accommodation may also be refused.


11.5 Pets

Two pets are allowed per pitch, provided that they are notified at the time of booking or upon arrival on site. Pets are not allowed to roam freely and must be kept on a lead, including on the rented pitch. They are not allowed in the water area, the children's playground and the sanitary blocks. Animal faeces must be collected by the Client and their behaviour must not disturb the peace and quiet of other guests. The Client is requested not to leave his/her dog alone. The reception of animals is subject to two conditions: - valid anti-rabies vaccination - identification by tattoo or chip certified by a card issued by the Société Centrale Canine. The client must bring the animal's health record. Dangerous or aggressive animals (including 1st and 2nd category dogs) and exotic animals are not accepted.



11.6 Visitors

Any visitor invited by the Client must be reported and registered at the campsite reception. The Campsite reserves the right to refuse access to the services of the Campsite. The Visitor is obliged to respect the Rules of the Campsite.

For any visitor aged 7 years and over, staying more than 2 hours on the campsite, a fee must be paid. The amount is fixed according to the current tariff. For less than 2 hours, visitors are admitted free of charge on the site, but without access to the water park. Their vehicle is not allowed inside the campsite and must remain in the communal car park.



Article 12. Liability

Open-air hotels do not fall within the scope of the liability of hoteliers as provided for in Article 1952 of the Civil Code. Consequently, the campsite cannot be held responsible for the loss, theft or damage of personal belongings, whether in the campsite, car parks or communal areas (bicycle rooms, toilets, etc.). It is specified that parking is at the Client's own risk. The Client is required to take out civil liability insurance and, if necessary, to contact his usual insurance company to extend the guarantees of his comprehensive home insurance to the accommodation occupied for the duration of the stay.

For all stages of access to the Websites, the reservation process and subsequent services, the Company has only an obligation of means. Although the Campsite makes every effort to maintain an operational service, it cannot offer any guarantee as to the continuity of access to its Websites and therefore declines all responsibility for any direct and/or indirect damage caused by the impossibility of accessing them in whole or in part or which may arise from the use of the service by an Internet user. The Campsite cannot be held criminally or civilly liable for the consequences resulting from inappropriate or unauthorised use of the Websites or their contents by users or any other third party.

The Campsite shall not be held liable for any false, misleading or erroneous information given in the catalogues or on the Websites concerning the Campsites, in particular the presentation photos, descriptions, activities, leisure activities, services and dates of operation, as a result of the communication by any third party of photographs to which they have declared that they have the rights.

The Campsite shall not be held responsible for the non-performance or poor performance of the contract entered into, in the event of fault on the part of the Customer, in the event of force majeure or the unforeseeable and insurmountable act of a third party unrelated to the provision of the services provided for in the contract. In any case, in the event that the Campsite is found to be liable for any reason whatsoever, any possible compensation shall be limited to the amount of the stay.


Article 13. Complaints

Any complaint must be reported by the Customer during his stay to the Campsite so that the latter can remedy the non-conformity or establish it. If the non-conformity cannot be remedied on the spot, the Customer can send a written complaint to the Customer Service Department so that the latter can try to remedy the situation. In order to be able to study the complaint as well as possible, the Customer is asked to provide as soon as possible all the factual elements (photographs, videos, etc.) that he/she can gather, except if the non-conformity was noted on the spot by the Campsite. Any complaint relating to the Customer's stay must be sent by the Customer by post to the campsite's address or by e-mail to contact@lebardou.com, or the campsite's e-mail address. No complaint can be taken into account for an incident that has not been reported to the campsite manager during the stay.



Article 14. Protection of personal data

14.1 Collection of data

When browsing our websites, information is collected about our Customers.

There are 3 categories of information:

- The information that the Client communicates to us when requesting a reservation: surnames, first names and dates of birth of all the participants, postal address, e-mail address, telephone number.

In the event of a pre-check-in, the Client can access his Client space and complete the following information: those relating to the vehicle (number plate, colour and make of the vehicle) and those relating to the pet provided for in the reservation (category and tattoo number).

- Information that we collect automatically: cookies (see Cookie Usage Policy).

- Information that we collect from third parties.

All this information is considered by the Company to be confidential. It is used solely by the internal services of CAMPING LE BARDOU, to process the Client's request and to strengthen and personalise communication and the services offered to Clients.


14.2. Dissemination of personal data to a third party

The Customer is informed that personal data concerning him/her is used by service providers of the Campsite such as Guestapp and Coolncamp in order to collect his/her opinion on the stay and to facilitate his/her stay on the Campsite. These service providers use the personal data only in the context of their partnership with the Campsite and for the sole purpose of the latter. They formally refrain from communicating to anyone any personal or nominative information that could identify the Client or that could infringe on his/her privacy.

The Customer has the possibility of objecting to the distribution of his personal data to partners via the address contact@lebardou.com.

In accordance with the order of 20 December 2017, the Customer may request:

- Access to his personal data;

- Rectification and deletion of their personal data (right to be forgotten);

- The right to data portability;

- The right to object to the processing of their data;

- To withdraw consent or limit the use of their data;

- The right to define directives concerning the conservation, deletion and communication of personal data after one's death and to oppose telephone canvassing by registering on the BLOCTEL list;

- The right to lodge a complaint with the CNIL or the Supervisory Authority of their place of residence.

To do this, simply make the request by email to contact@lebardou.com, or by mail to the following address, CAMPING LE BARDOU - 260 Rue Olivier de Serres 07170 ST-GERMAIN. For any request, a valid proof of identity must be sent for security reasons and a copy of the communication received to facilitate the processing of your request.


Article 15: Image

During the stay, the Client may be photographed or filmed on the site. By accepting the General Terms and Conditions of Sale, the Customer authorises the Campsite, its representatives and any person acting with the permission of the Campsite to capture, reproduce, communicate, disseminate and exploit his image. This authorisation also applies to all persons staying with the Client. Nevertheless, the Client may object to this practice in writing to the Reception of the Campsite. These images may be used for promotional, commercial or internal and external communication purposes, on any type of medium known or unknown to date (internet, paper, audiovisual, etc.). This use may not exceed a period of 7 years. The Company expressly refrains from using the images in any way that might infringe on privacy or reputation, and from using the images in any medium of a pornographic, racist or xenophobic nature or any other prejudicial use. The Client acknowledges that he cannot claim any remuneration for the exploitation of the rights in question.



Article 16. Applicable law, jurisdiction and mediation

The present General Terms and Conditions of Sale are subject to French law and any dispute relating to their application falls within the jurisdiction of the Courts of the Ardèche, regardless of the Customer's country of origin. In the event of a complaint and after having referred the matter to the Campsite's customer service department in accordance with the Complaints procedure, the Customer may refer the matter to a consumer mediator within a maximum period of one year from the date of the written complaint, by registered letter to the operator. In application of the provisions of Article 1368 of the Civil Code, it is expressly agreed that the data stored in the Company's and/or its partners' information systems have evidential value. Thus, the data on computer or electronic media thus stored, if produced as evidence by the Company in any litigation or other proceedings, will be admissible, valid and enforceable between the parties.


Article 17. Partial non-validation of the General Terms and Conditions of Sale

In the event that one of the clauses of these General Terms and Conditions of Sale is null and void due to a change in legislation, regulations or a court decision, this shall in no way affect the validity and compliance with these General Terms and Conditions of Sale.
