PREAMBLE
The present conditions govern the contractual relations relating to the sale of holidays between the company SARL LA GRAPPE FLEURIE and its clients, in accordance with the provisions of articles L. 211-1 and following of the Tourism Code. They regulate all the steps necessary for the booking and payment of the stays, and regulate all their follow-up between the contracting parties. Any document other than the present general terms and conditions of sale, and in particular prospectuses, advertisements, catalogues, has only an informative and indicative value.
INTEGRALITY
The present general conditions express the entirety of the obligations of the parties. In this sense, the CUSTOMER is deemed to accept them without reservation and in accordance with the provisions of Article 1126 of the Civil Code. The present general terms and conditions for renting and booking stays at Camping La Grappe Fleurie apply to the exclusion of all other conditions. They are accessible on the website www.beaujolais-camping.com and will prevail, if necessary, over any other version or any other contradictory document. The SARL LA GRAPPE FLEURIE and the CUSTOMER agree that these general conditions exclusively govern their relationship. The SARL LA GRAPPE FLEURIE reserves the right to modify its general conditions from time to time. They will be applicable as soon as they are put online. If a rental or reservation condition is missing, it will be considered to be governed by the practices in force in the campsite pitch rental sector.
CAPACITY
The person making the reservation must be of legal age, legally capable of contracting the rental in accordance with these conditions and of guaranteeing the accuracy and truthfulness of the information provided.
SUBJECT
The purpose of these general conditions is to define the rights and obligations of the parties in the context of the rental of camping pitches, rental accommodation or stays offered to the customer at Camping La Grappe fleurie, from the campsite's website, but also by telephone, or by mail, by e-mail.
PRE-CONTRACTUAL INFORMATION
The CUSTOMER acknowledges having been informed, prior to making a reservation, of these general terms and conditions of sale, rental and stays, and of all the information listed in article L. 111-1 of the French Consumer Code. The CLIENT has all the information available online or can have the services explained to him/her by telephone or electronically.
SERVICES AND PRICES
Rental of pitches
Camping La Grappe Fleurie provides the customer with a bare pitch for up to 6 people, for his tent, caravan or motor home.
This is a fixed price per night of occupation for the type of pitch concerned. The basic package includes one installation, 1 or 2 persons and a vehicle. The comfort package also includes an electricity connection. Additional persons (adults or children) or additional elements present on the pitch (second vehicle, animal, additional tent etc.) are subject to an additional daily cost. The basic package gives free access to the sanitary facilities, reception, the swimming pool (on opening dates), the playgrounds and the activities offered free of charge or for a fee. For safety reasons, the number of people arriving for a stay cannot exceed the capacity of the campsite pitch. Pitches are available from 2pm on the day of arrival and must be vacated before 12 noon on the day of departure.
Rental accommodation
The description, the definition of the rental seasons, rental periods and tariff periods are on the website. The price of accommodation rental includes the rental of the accommodation, depending on the number of people (according to capacity), charges (water, gas, electricity), a vehicle, access to reception services, the swimming pool (on opening dates), playgrounds, other equipment and the activities offered (free or paying). For security reasons, the number of people arriving during the stay cannot exceed the capacity of the accommodation. The accommodation is fully equipped and must be left in a clean and tidy condition on departure. The rentals are non-smoking. Rentals are available from 4pm on the day of arrival and must be vacated before 10am on the day of departure (in case of subscription to the Extended Stay option, the arrival and departure times mentioned above will vary).
The rental of rental accommodation or camping pitches is nominative and may not be transferred or sublet.
PRICES EVOLUTION
Rates may change as the season progresses. The SARL LA GRAPPE FLEURIE cannot be held responsible for any difference in cost between two stays booked for the same period. The rates indicated on the site are in euros, including VAT at the rate in force at the time of the date of receipt of the deposit and the total price. Any change or modification of the rate as well as any change in the taxes applicable to the stay, on the date of invoicing, may be passed on to the price of the stay.
VAT
Changes in VAT will lead to changes in the price of the stay including VAT.
PROMOTIONS
Promotions are applicable to the reservation. They will not give rise to any claim or refund a posteriori. Promotional offers are subject to certain conditions and in particular to availability. Moreover, price reductions or promotional operations cannot be combined unless otherwise stated. On these occasions, it is possible that for the same stay, customers may have paid different prices. Customers who have paid the higher price will not be able to benefit from a refund of the difference between the price they have paid and the promotional price.
TOURIST TAX
The tourist tax collected on behalf of the Saône Beaujolais Community of Communes and to be paid, is not included in our rates. Its amount per person and per day is determined each year by the CCSB.
RESERVATION AND PAYMENT
RESERVATION CONDITIONS
The customer has the possibility to make a reservation online, by phone or by mail. All reservations must be accompanied by a payment including :
- A 30% deposit
- Administrative fees
-and of the possible subscription to the cancellation-interruption of stay insurance.
Whatever the chosen channel, the reservation becomes effective only after the written confirmation of the reservation has been sent by Camping La Grappe Fleurie by email (this confirmation can be sent by post on request) and, after collection of the amount due of the deposit, and of the eventual booking and cancellation insurance fees.
WEBSITE BOOKING
Concerning online reservations, in order for the order to be validated, the customer must accept, by clicking in the indicated place, the present general conditions and validate his payment. Following his reservation, the customer will receive a confirmation by e-mail containing the details of his stay (content of the services, dates and duration, price and terms of payment).
Electronic signature applicable to online sales
The online provision of the customer's credit card number and the final validation of the order will be proof of the customer's agreement:
- Payability of the sums due for the reservation,
- signature and express acceptance of all operations carried out.
If the CLIENT chooses, during the online booking process, another means of payment. The reservation will be effective only after receipt of the confirmation sent by e-mail by the Campsite and receipt of the payment.
THE PARTICIPANTS OF THE STAY
The number of tenants must precisely respect the living capacities of the rentals and locations. The complete list of participants (name, first name and date of birth) must be handed in at the reception, at the latest on the day of arrival.
TERMS OF PAYMENT
Payment for pitches
The balance must be paid on the day of arrival after re-calculation of the actual stay. In the case of a subscription to the cancellation insurance, the balance must be paid 30 days before the day of arrival.
Rental payment
The balance of the stay must reach the campsite no later than 30 days before the date of arrival (holiday vouchers are sent by registered mail with acknowledgement of receipt). After this deadline, in the absence of full payment, we will consider your rental as cancelled and will keep the sums already paid.
WARNING, VACAF cheques are not accepted.
Last minute booking
Any reservation made less than 30 days before the date of arrival must be paid in full. The reservation will only be effective upon receipt of payment and as long as the stay is still available.
NO RIGHT OF WITHDRAWAL
According to Article L. 221-28 12° of the Consumer Code, the right of withdrawal is not applicable to accommodation, transport, restaurant and leisure services provided on a specific date or at a specific time.
METHOD OF PAYMENT
Camping La Grappe Fleurie accepts the following means of payment:
For the payment of the deposit: credit card (the accepted cards are those of the networks Cartes Bleues, VISA, Mastercard, Maestro). bank cheques, holiday cheques (the sending must be done by mail with acknowledgement of receipt).
For the payment of the balance: credit card (the accepted cards are those of the networks Cartes Bleues, VISA, Mastercard, Maestro). (the sending will have to be made by mail in Letter with acknowledgement of receipt, and cash in Euros physically handed over at the reception of the campsite.
SITE ALLOCATION
Places are allocated without distinction and in order of registration in order to optimize the schedule. The management of Camping La Grappe Fleurie can in no way guarantee that the pitch requested by the customer will be allocated.
STAY MODIFICATION
The customer may request a modification of his stay at the latest 60 days before his arrival date (modification concerning the date and/or type of accommodation) by written request to the campsite (only by post), subject to availability and possibilities. No postponement will be accepted to the following season. The customer's attention is drawn to the fact that in case of modification of the stay, it will not be possible for him to benefit from the promotions subsequent to his initial reservation, the date of the first reservation being taken as proof. In the absence of modification, the client must make his or her stay under the initial booking conditions or cancel it according to the conditions of the cancellation insurance.
Any request for an increase in the length of your stay will be made according to availability and according to the rates in force.
Any request to reduce the length of your stay is considered as a partial cancellation and will be subject to the terms and conditions of cancellation and interruption of stay.
In the absence of notification by e-mail or mail from you indicating a postponement of your arrival date, the accommodation may be available for sale again from 2:00 pm the day after your scheduled arrival and you will lose the benefit of your reservation. Concerning the pitches, they can be put back on sale from 8:00 pm on the day of arrival.
STAY CANCELLATION
Cancellation due to Camping La Grappe Fleurie :
In case of cancellation due to the Camping La Grappe Fleurie, except in case of force majeure, the stay will be fully refunded (the booking fees and the payment of the cancellation insurance will be kept). However, this cancellation will not give rise to the payment of damages.
Cancellation (total or partial) by the customer :
This one will have to warn the CAMPING LA GRAPPE FLEURIE by sending a letter IN RECOMMENDED LETTER WITH NOTICE OF RECEPTION to the following address: CAMPING LA GRAPPE FLEURIE - 161 RUE DE LA GRAPPE FLEURIE - 69820 FLEURIE. The date of receipt of the cancellation will determine any cancellation fees. Failing this, the client will be required to pay the sums due under the contract. Regardless of the date of cancellation, the booking fees and any insurance taken out are non-refundable.
No refund can be made except in the case of subscription to the cancellation insurance, and under the conditions of the latter (see paragraph Cancellation insurance).
If the cancellation occurs :
More than 30 days before the date of the beginning of the stay : the deposit will be kept.
Less than 30 days before the start date of the stay: 100% of the amount of the stay will be required and no refund will be given.
CANCELLATION AND INTERRUPTION OF STAY INSURANCE
Cancellation and interruption of stay insurance is optional but the CUSTOMER is invited to subscribe to it at the time of booking. Its amount is a percentage of the total amount of the stay ( 5 % ). This insurance covers in particular the cancellation of the stay in case of illness (hospitalization), serious accident or death, claims causing significant damage to your home, dismissal or modification of your leave due to the employer, as a result of a summons to an examination or before a court of law. The full terms and conditions of the cancellation insurance contract are available on request and on our website. LATE ARRIVAL, EARLY DEPARTURE
In the absence of a message from the CUSTOMER acknowledging receipt, specifying that he has had to postpone the date of his arrival, the pitch becomes available from 8pm the same day, the accommodation becomes available from 2pm the next day, and full payment of the services remains required. No reduction will be granted in the case of an early departure in rental accommodation (see possibilities of refund in the framework of the cancellation insurance).
DEPOSIT
For any rental stay, a deposit of 360 € will be required, at the latest at the time of check-in by credit card (cheques and cash are not allowed). This will be returned in full on the day of departure or within eight days at the latest, after a cleaning check and a satisfactory state of the equipment. Otherwise, the deposit will be taken in part or in full. Damage in excess of the amount paid as a deposit will be charged to the customer.
HOUSEHOLD
The CLIENT must return the accommodation in a perfectly clean condition. We offer you a HOUSEHOLDING option, which exempts you from having to do the cleaning on your departure. The price of this service is indicated in our options price table.
LEISURE ACTIVITIES
Any free or paid activity mentioned on our website, in an email or offered on site may, under certain circumstances, be modified or cancelled upon your arrival on the site.
MINORS
Minors not accompanied by their parents are not accepted.
ANIMALS
The agreement of the campsite is necessary for the stay of all animals. The management reserves the right not to accept a stay if it has not been warned in advance and if it has not given its agreement.
In any case, a maximum of two pets may be accepted per accommodation or pitch, subject to payment of a lump sum per day. Pets are not allowed to circulate freely and must be kept on a leash. They are not allowed in the communal areas (room, bar, swimming pool, tennis court). They are welcome under two conditions: - Valid rabies vaccination - identification by tattoo or chip certified by a card issued by the Société Centrale Canine. The client must have the animal's health record and comply with the internal regulations of each site. Dangerous or aggressive animals (1st and 2nd category dogs prohibited) as well as new pets are not accepted.
VISITORS
Visitors (i.e. people who are not customers of Camping La Grappe Fleurie and who come to visit customers of Camping La Grappe Fleurie ) are strictly forbidden.
HOUSE RULES
In order to facilitate the stay of all our guests, an internal regulation is available at the reception. It is imperative to read and respect them. In the case of non-respect of these rules, the campsite managers can take sanctions which can go as far as the cancellation of the contract.
LIABILITY INSURANCE
Liability insurance is mandatory. It is up to the client to insure himself for any damage he might cause in the campsite or the rental property and for his belongings, suitcases, valuables and vehicles.
LOSS, THEFT, DAMAGE
LA GRAPPE FLEURIE CAMPING declines all responsibility in the event of theft or damage to personal objects both in the accommodation and in the common areas. LE CAMPING LA GRAPPE FLEURIE cannot be held responsible in the event of theft or damage to the personal belongings of clients except in the event of a proven breach by the campsite of its contractual obligations. It is also reminded that the car park is not guarded and that parking is therefore at the client's own risk. LA GRAPPE FLEURIE CAMPING also declines all responsibility in the event of an incident falling under the CLIENT's civil liability.
PRIVATE DATA
The personal data of customers are collected and processed by LA SARL LA GRAPPE FLEURIE . Some data are essential to manage the booking of the CLIENT's stay and will also be used to send him/her information and/or promotional offers. In accordance with article 40 of the law n° 78-17 of January 6, 1978 called the Informatique et Libertés law, the CUSTOMER has the right to access, modify, correct and delete personal data concerning you. PHOTOS AND IMAGE RIGHTS
Photos of brochures, websites and any other communication media are not contractual.
You expressly authorise LA SARL LA GRAPPE FLEURIE to use on any support the photos of you or your children which could be taken during your stay, for advertising purposes.
MAJOR STRENGTH
Any circumstances beyond the control of the Parties which prevent the performance of their obligations under normal conditions shall be considered as grounds for exemption from the Parties' obligations and shall lead to their suspension. The party invoking the circumstances referred to above shall immediately notify the other party of their occurrence, as well as of their disappearance. Will be considered as cases of force majeure all irresistible facts or circumstances, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts. Expressly, are considered as force majeure or fortuitous events, in addition to those usually retained by the jurisprudence of French courts and tribunals: storms, floods, lightning, earthquakes, fires, stoppage of telecommunication networks or difficulties specific to telecommunication networks external to the customers blocking means of transport or supplies. The parties will come together to examine the impact of the event and agree on the conditions under which the execution of the contract will be continued. If the case of force majeure lasts more than three weeks, the site rental and accommodation contracts will be cancelled by right.
NO PARTIAL VALIDATION
If one or more stipulations of these general conditions are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain their full force and scope.
NON-WAIVER
The fact for one of the parties not to take advantage of a breach by the other party to any of the obligations referred to in these terms and conditions can not be interpreted for the future as a waiver of the obligation in question.
LANGUAGE OF THE CONTRACT
The present general conditions of sale are written in French. In the event that they are translated into one or more foreign languages, only the French text shall be deemed authentic in the event of a dispute.
MEDIATION
In the event of any dispute which may arise concerning the validity, interpretation, execution or non-execution, modification or cancellation of the contract, the CLIENT and CAMPING LA GRAPPE FLEURIE will endeavour to find an amicable solution. To this end, the client will send his complaint by registered letter with acknowledgement of receipt to CAMPING LA GRAPPE FLEURIE - RUE DE LA GRAPPE FLEURIE - 69820 FLEURIE within one month of the stay. In the absence of a response deemed satisfactory by THE CUSTOMER or by CAMPING LA GRAPPE FLEURIE to a claim made under the conditions previously mentioned, the most diligent party will submit the dispute to CM2C, a mediation body initiated by the National Chamber of Bailiffs. For the full information of the customer, it is indicated that the use of CM2C is a free procedure for him, even if he would be at the initiative of his referral. To find out more about CM2C: https://www.cm2c.net/ In the event of failure of the mediation, the customer and LA SARL LA GRAPPE FLEURIE may refer the matter to the competent French court.
APPLICABLE LAW
The present general conditions are subject to the application of French law. This is the case for the rules of substance as well as for the rules of form. In the event of a dispute or claim, the client will first contact CAMPING LA GRAPPE FLEURIE to obtain an amicable solution.
