GENERAL TERMS AND CONDITIONS

Article 1. Scope of the General Terms and Conditions of Sale
These general terms and conditions sent to the Customer form a contractual whole and constitute the entire contractual relationship between the Campsite and its Customers. They govern the sale of holidays by the Campsite and are valid at the time the order is placed to the exclusion of all other conditions. The Campsite reserves the right to modify its general terms and conditions at any time. However, the version applicable to the Customer is the one accepted at the time of booking.

Article 2. Acceptance of the General Terms and Conditions of Sale
The Customer is deemed to accept these General Terms and Conditions of Sale without reservation, in accordance with the provisions of article 1126 of the French Civil Code. The Customer is therefore fully aware that, by ticking the box I confirm that I have read the General Terms and Conditions of Sale when placing an order on the Internet or by receiving the booking confirmation email to which these terms and conditions are attached, he/she is giving his/her specific, free and informed consent, particularly with regard to the use of personal data. This unreserved acceptance is valid both for the Customer and for any person taking part in the holiday. These General Terms and Conditions of Sale are also available on the Campsite's website and at the Campsite Reception.
Article 3. Booking
3.1 Booking conditions
Method of reservation - The Customer may make a reservation online, by telephone or at the Campsite.
Validation of the booking - Any booking request is considered to be a definitive booking once it has been accepted by the Campsite. The Campsite is at liberty to refuse a booking, depending on availability or any other circumstance likely to affect the planned stay. Acceptance of a booking is confirmed exclusively by sending a booking confirmation by e-mail, post or by hand delivery. In order to be validated, all bookings must also be accompanied by a payment including :
- A deposit of between 30% and 100% of the total cost of the holiday, depending on the date of booking;
- Booking fees;
- Any cancellation/interruption insurance costs.
Electronic signature applicable to online sales - The online provision of the customer's bank card number and the final validation of the order will be deemed to be proof of the customer's agreement to the payment of the sums due for the booking and the signature and express acceptance of all the operations carried out.
Capacity and participants in the holiday - Reservations are made by name. The Customer must be over 18 years of age, be taking part in the holiday booked and legally provide the surnames, first names and dates of birth of all participants, including minors and newborn babies. The Campsite reserves the right to refuse any person not registered at the time of booking. Any incorrect information may result in the cancellation of the holiday. Due to the personal nature of the booking, it may not be transferred or sublet in whole or in part without the prior express written agreement of the Campsite. For safety and insurance reasons, the maximum number of occupants per type of accommodation/site, as described in the brochure and on the website, must be respected. The Campsite will not accept any person in excess of this capacity (including new-born babies), with the exception of any visitors invited by the Customer for the day.
Groups - The Campsite offers family-oriented holidays, with accommodation specially designed for this purpose. The Campsite reserves the right to refuse any booking that does not match the capacity of the accommodation offered. The Campsite considers that any reservation(s) of 5 or more rental accommodations / pitches made by the same natural person or by different natural persons who know each other and are travelling together for the same reasons, on the same dates and on the same Campsite is a group.
All group reservation requests must be sent by e-mail to contact@camping-le-perigord.com or by telephone to 05.53.54.14.22 (price of a local call depending on your operator) specifying that it is a group reservation request. The campsite reserves the right to examine the request before accepting or refusing it.
3.2 Important information
Minors - For obvious reasons of safety (swimming pool, evacuation of the campsite in the event of an alarm, etc.) and health (hospitalisation, etc.), minors who are not accompanied by their legal guardians, as defined in article 389 of the French Civil Code, are not admitted. Furthermore, in accordance with decree 2002-883 of 3 May 2002, the Campsite is not authorised to provide group or individual holidays away from the family home for minors under the age of 18 who are not accompanied by one of their legal guardians. Minors accompanied by their legal guardians are placed under the sole responsibility of the latter and must under no circumstances be left unsupervised on the campsite premises (including the water park).
Non-contractual nature of communication media - Any document other than these General Terms and Conditions of Sale, and in particular catalogues, prospectuses, advertisements and notices, is for information purposes only and is not contractually binding. Plans and photos of rental accommodation are given for illustrative purposes only. The layout and characteristics of the rooms may differ from those shown.
The layout and characteristics of the rooms may vary from one model to another. Please refer to the written description of the accommodation available in the accommodation section of the campsite website for the exact layout of each rental accommodation. A description is also available inside each rental accommodation. If you have any questions, our booking centre is at your disposal on 05.53.54.14.22 (price of a local call depending on your operator).
Campsite facilities and activities - It may happen that certain activities and facilities offered by the campsite (directly or through service providers), such as wifi or elements of the water park, listed in the description, are cancelled, particularly for climatic reasons or in cases of force majeure, or do not operate, particularly in the early and late seasons. The Campsite may not be held liable in such cases. The Campsite will inform the Customer of any works / contingencies / improvements undertaken during the stay.
The price includes :
- Rental of the pitch or fully-equipped rental accommodation as defined in the brochure and on the websites;
- Water, gas and electricity consumption (excluding any recharging of your electric vehicle at the domestic socket on your pitch);
- Access to the campsite, its facilities and activities (except list below) as defined in the brochure and on the websites;
- The pitch for one car per rental (the pitch is not necessarily on the rented pitch).
The price does not include :
- Booking fees ;
- Various taxes;
- Paid activities offered by the campsite to be paid for on site;
- Supplements such as cleaning costs;
- Security deposits;
- Guarantee of a specific pitch;
- Cancellation and interruption insurance;
- Optional equipment.

Article 5. Terms and conditions of payment
5.1 Terms of payment
The full price of the holiday is payable :
- 30 days before the start of the holiday;
- Or immediately for any booking made less than 30 days before the start of the holiday. If full payment is not received by the agreed date, the Campsite is entitled to consider that the Customer has cancelled the booking and will retain any sums already paid. For groups, the terms of payment are specified in the contract sent at the time of booking.
5.2 Payment methods
The methods of payment of the deposit and/or the total amount of the stay accepted by the Campsite vary according to the date of payment:
- If payment is made at least 30 days before the date of arrival: payment may be made by credit card, bank transfer, holiday vouchers (sent by recorded delivery with acknowledgement of receipt) or connect holiday vouchers and by cheque in euros (sent by recorded delivery with acknowledgement of receipt).
- If payment is made between 29 and 15 days before the arrival date: payment can be made by credit card, bank transfer or connect holiday vouchers.
- If payment is made between 14 days and the day before arrival: payment can be made by credit card or bank transfer.
- For payment on site: the customer may pay the balance by credit card, cash or holiday vouchers. Cheques are not accepted on the campsite.
5.3 Details of credit card payments
The bank cards accepted are those of the Carte Bleue, (Visa, Eurocard/Mastercard) networks. American Express is not accepted. The transaction is immediately debited from the Customer's bank card after verification of the card details. In accordance with article L.132-2 of the French Monetary and Financial Code, the commitment to pay given by means of a payment card is irrevocable. By providing his/her bank card details either online or by telephone, the Customer authorises the Campsite to debit his/her bank card.
To this end, the Customer confirms that they are the holder of the bank card to be debited and that the name appearing on their bank card is indeed their own. In the event of fraudulent use of the bank card, the Customer is invited, as soon as this is discovered, to contact our reservations centre on 05.53.54.14.22 (price of a local call depending on your operator).

Article 6. Services not included in the price
6.1. Booking fees
Booking fees are payable for each named booking. This fee is set by the campsite at the time of booking. They are payable at the time of booking and are non-refundable.
6.2. Tourist tax
Tourist tax is collected on behalf of the local authorities and is payable at certain campsites. The amount, determined per person per day, varies depending on the destination and may be changed during the year.
6.3. Paid activities offered by the Campsite to be paid for on site
Some activities offered by the Campsite or one of its service providers are optional and chargeable. Please note that access to the campsite's water park is not a chargeable activity. If you have any questions, our reservation centre is at your disposal on 05.53.54.14.22 (price of a local call depending on your operator).
6.4. Cleaning costs
The Customer may request that the departure cleaning be carried out by the Campsite for a fixed cleaning fee of an amount that varies according to the range of the accommodation.

6.5. The security deposit
For any stay at the Campsite, a deposit of 100€ for pitches (in the case of hire of a fridge and/or plancha) and 250€ for rental accommodation will be required no later than the day of arrival at the Campsite. Payment can be made by credit card or cheque. The deposit will be returned in full on the day of departure, or within a fortnight at the latest, once the campsite has been checked and the equipment has been left in a satisfactory state. Otherwise, the deposit will be deducted in full. Any damage in excess of the amount paid as a security deposit will be charged to the Customer after the security deposit has been deducted. In the case of a cash deposit, and if the Customer wishes to have the amount returned immediately upon departure, it is the Customer's responsibility to make an appointment no later than the day before departure in order to carry out an inventory of the accommodation.
6.6. Guarantee of a specific pitch / Preferential pitch option
Pitches are allocated by the Campsite according to availability, in order to optimise planning. This allocation may be changed at any time before the keys are handed over. Only the location, dates and type of accommodation are guaranteed, unless the Customer chooses the Preferential pitch option. If the pitch of their choice is available or if they wish to be next to another pitch, they will be allocated and, in return, must pay a fixed fee of €25.
6.7. Prohibition on recharging electric vehicles using the domestic socket on the pitch
It is strictly forbidden to charge an electric vehicle using a domestic socket on the campsite pitches. The campsite's electrical installation, which is dedicated to the proper operation of the accommodation and infrastructure, is in no way suitable for recharging customers' vehicles. Should the Customer fail to comply with the aforementioned ban on recharging, an initial warning will be left on the vehicle. For each new charge after this warning, a lump sum of €150 including VAT will be deducted from the Customer's security deposit.
6.8 Optional equipment
The campsite offers optional equipment such as baby kits, fridges, sheets, towels, barbecues, etc. This equipment is provided on request and subject to availability. If you have any questions, our reservations department is at your disposal on 05.53.54.14.22 (price of a local call depending on your operator).

Article 7. Partner benefits and promotional offers
Promotional offers are subject to certain conditions and cannot be combined unless otherwise stated. Partner benefits and promotional offers cannot be applied to a booking that has already been paid for in full or in part. On these occasions, it is possible that for the same booking, the same number of people may be excluded from the offer.
Customers who have paid the highest price will under no circumstances be entitled to a refund of the difference between the price they have paid and the promotional price. In order to benefit from a partner advantage, the Customer must prove that he/she is entitled to said advantage in accordance with the provisions agreed with the service provider. Holders of partner benefits must be holders of the holiday. The Campsite will check the applicability of the offer. In the event of fraud, the amount of the discount will be claimed from the Customer.


Article 8. Withdrawal
The Customer is hereby informed that, pursuant to article L. 121-20-4 of the French Consumer Code, the sale of accommodation services provided on a specific date or at a specific time is not subject to the provisions relating to the withdrawal period applicable to distance selling. No right of withdrawal therefore applies to the sale of holidays by the Campsite. However, this derogation does not apply to any insurance policies taken out (14-day period in accordance with and within the framework of the legal provisions).

Article 9. Changes to the booking/stay
Any request for modification must be made at least 10 days before the start of the holiday. It is the Customer's responsibility to make the request to the Campsite by registered post with acknowledgement of receipt to the Campsite's address or by sending an e-mail to the following address contact@camping-le-perigord.com.
The Campsite will do its utmost to accommodate the request, subject to availability and the applicable rates. If the change is not possible or accepted, the Customer will have to make the stay as originally planned or cancel it.

Article 10. Cancellation of stay (excluding cancellation/interruption insurance)
10.1 Cancellation by the Campsite
Except in cases of force majeure, the stay will be refunded in full. Under no circumstances may this cancellation give rise to the payment of damages.
10.2 Total or partial cancellation by the Customer
It is the Customer's responsibility to notify the Campsite by registered post with acknowledgement of receipt to the Campsite's address or by sending an e-mail with acknowledgement of receipt to contact@camping-le-perigord.com . The date of receipt of the cancellation will determine any cancellation charges. In the absence of any written notice under the aforementioned conditions, the Customer will be liable for payment of all sums due in respect of the reservation. The scale of cancellation charges applicable is as follows:
- Up to and including the 31st day before the holiday: 30% of the total cost of the rental plus additional costs (administration and insurance) will be charged.
- Less than 30 days before the holiday or in the event of a no-show: the full amount due for the booking will be invoiced. Please note that regardless of the date of cancellation, the administrative costs will be charged to the client.
Article 11. Course of the holiday
11.1 Arrival and departure times
Camping pitches - Arrivals are from 12 noon and departures before 12 noon.
Accommodation rental - Accommodation is available from 4pm and must be vacated by 10am at the latest on the day of departure. In the event that a Customer is unable to respect the arrival times, it is their responsibility to contact Reception immediately to try to find a solution. In the event of no-show within 24 hours of the scheduled arrival date and without a written notice sent to the Campsite confirming the date of arrival, the Campsite reserves the right to put the accommodation/pitch up for sale. No refund or compensation will be made. No reductions will be made for late arrivals or early departures. In the event of a delay in handing over the keys / releasing the pitch, an additional night will be charged.

11.2 Length of stay
The minimum length of stay may vary depending on the type of pitch/rental and the period of stay. The minimum length of stay for rental accommodation is 2 nights from the opening to the closing of the campsite.
11.3 Check-in / Check-out
Check-in - On arrival, Reception will check the Customer's balance. The Customer must have paid the balance in full, present a valid official identity document and deposit the security deposit in accordance with the following conditions.
After registering the Customer's arrival, Reception will give the Customer the keys to the rental accommodation, any access card to the Campsite and regulatory information. It is the Customer's responsibility to check the inventory on arrival and to report any discrepancies within a day of arrival.
Check-out - It is the Customer's responsibility to return their accommodation in a clean and tidy condition before 10am. Failure to do so may result in the deduction of a cleaning fee. Similarly, any object broken, lost or damaged during the stay may be billed to the Customer. The security deposit will be returned under the conditions set out above.
11.4 House rules
During the stay, the Customer undertakes to comply with the campsite's house rules, which are available / displayed at reception and on the campsite's website. These rules apply to all persons residing with or under the responsibility of the Customer. Unless otherwise stated in the campsite rules or expressly authorised by the campsite, tents may not be erected on rental accommodation pitches. In the event of flagrant non-compliance with these rules, the Site Manager may impose penalties, including termination of the contract, particularly in the event of a disruptive attitude that is contrary to the calm and serenity of the reception or in the event of behaviour that is contrary to the rules of the campsite.
The Customer is informed that access to the accommodation may also be refused.
11.5 Pets
Two pets are allowed per rental accommodation or pitch, provided that they are notified at the time of booking or upon arrival on site. Pets are not allowed to roam freely and must be kept on a lead, including on the rented pitch. They are not allowed in the pool area, children's play area or toilet blocks. Animal faeces must be collected by the Customer and their behaviour must not disturb the peace and quiet of other customers. Customers are asked not to leave their dogs alone. Two conditions must be met before pets are accepted: - valid anti-rabies vaccination - identification by tattoo or chip certified by a card issued by the Société Centrale Canine. Customers must bring their pet's health record with them. Dangerous or aggressive animals (including 1st and 2nd category dogs) and exotic animals are not accepted.


11.6 Noise pollution
In accordance with the Campsite Rules and Regulations and in order to protect the peace and quiet of other residents, noise pollution is strictly prohibited on the Campsite. In the event that the Customer does not comply with the aforementioned prohibition, and after having been reminded orally for the first time and then a second time by hand-delivery of an If a written warning is not acted upon, the Customer may be excluded from the Campsite and banned from staying there in the future.
11.7 Guests
Any visitor invited by the Customer must be reported and registered at the Campsite Reception. The Campsite reserves the right to refuse them access to the Campsite's services. Visitors must comply with the Campsite Rules and Regulations. For all visitors aged 7 and over, staying more than 2 hours on the campsite, a fee must be paid. The amount is set according to the current tariff. For less than 2 hours, visitors are admitted free of charge to the site, but without access to the water park. Their vehicles are not allowed inside the campsite and must remain in the communal car park.

Article 12. Liability
Open-air hotels are not covered by the liability of hoteliers under article 1952 of the French Civil Code. Consequently, the campsite cannot be held liable for the loss, theft or damage of personal belongings, whether in the campsite, car parks or communal areas (bicycle rooms, sanitary facilities, etc.). Parking is at the Customer's own risk. It is the Customer's responsibility to take out civil liability insurance and, if necessary, to contact their usual insurance company to extend their comprehensive home insurance cover to the accommodation occupied for the duration of their stay. For all stages of access to the Internet Sites, the Company has no control over the Customer's personal details.
Although the Campsite makes every effort to maintain an operational service, it cannot offer any guarantee as to the continuity of access to its Websites and therefore declines all responsibility for any direct and/or indirect damage caused by the impossibility of accessing them in whole or in part or which may arise from the use of the service by an Internet user. The Campsite may not be held criminally or civilly liable for the consequences resulting from inappropriate or unauthorised use of the Websites or their content by users or any other third party. The Campsite may not be held liable for any false, misleading or erroneous information given in the catalogues or on the Websites concerning the Campsites, in particular the presentation photos, descriptions, activities, leisure activities, services and dates of operation, as a result of the communication by any third party of photographs to which they have declared that they have the rights. The Campsite may not be held liable for the non-performance or improper performance of the contract entered into in the event of fault on the part of the Customer, in the event of force majeure or the unforeseeable and insurmountable act of a third party unrelated to the provision of the services provided for in the contract. In any event, should the Campsite be held liable for any reason whatsoever, any compensation shall be limited to the cost of the stay.

Article 13. Complaints
Any complaint must be reported to the Campsite by the Customer during his/her stay so that the Campsite can remedy the non-conformity or establish it. If it has not been possible to remedy the non-conformity on site, the Customer may send a complaint in writing to Customer Services so that they can try to remedy it. In order to best investigate the complaint, the Customer is asked to provide as soon as possible any factual information (photographs, videos, etc.) that he/she may be able to gather, unless the non-conformity has been noted on site by the Campsite. Any complaint relating to the Customer's stay must be sent by the Customer by post to the address of the Campsite or by e-mail to contact@camping-le-perigord.com. No complaint will be considered for an incident that has not been reported to the Campsite Manager during the stay.

Article 14. Protection of personal data
14.1 Data collection When browsing our websites, information is collected about our Customers. There are 3 categories of information:
- Information provided by the Customer when requesting a booking: surnames, first names and dates of birth of all participants, postal address, e-mail address and telephone number. In the event of a pre-check-in, the Customer can access their Customer Area and complete the information requested.
(number plate, colour and make of vehicle) and those relating to the pet booked (category and tattoo number).
- Data that we collect automatically: cookies (see policy on the use of cookies).
- Information we collect from third parties. All this information is considered by the Company to be confidential. It is used solely by the internal services of Camping Le Périgord, to process the Customer's request and to reinforce and personalise the communication and services reserved for Customers.
14.2 Distribution of personal data to third parties
Customers are informed that their personal data is used by the Campsite's service providers, such as Guestapp and Coolncamp, in order to gather their opinions on their stay and to facilitate their stay at the Campsite. These service providers use personal data only in the context of their partnership with the Campsite and for the sole purposes of the latter. They are formally prohibited from communicating to anyone any personal or nominative information that might identify the Customer or infringe on his/her privacy. Customers may object to their personal data being passed on to partners at contact@camping-le-perigord.com. In accordance with the order of 20 December 2017, the Customer may request:
- access to their personal data,
- rectification and deletion of personal data (right to be forgotten),
- the right to data portability,
- the right to object to the processing of personal data,
- withdraw their consent or limit the use of their data,
- to define directives relating to the conservation, deletion and communication of personal data after their death and to oppose telephone canvassing by registering on the BLOCTEL list,
- the right to lodge a complaint with the CNIL or the supervisory authority in their place of residence. To do this, simply send a request by e-mail to contact@camping-le-perigord.com or by post to the following address, Camping Le Périgord, 2, Impasse du Pontet, 24110 Saint-Astier. For all requests, a valid proof of identity must be sent for security reasons, as well as a copy of the communication received in order to facilitate the processing of your request.
Article 15. Authorisation of image rights
During their stay, the Customer and the persons accommodated with them (hereinafter the Accommodated Persons) may be photographed or filmed within the Campsite as part of group shots (hereinafter the Images), which the Customer accepts on their behalf and that of the Accommodated Persons. The Customer also authorises the Campsite, on their behalf and on behalf of the Guests, to distribute the Images on their social networks for a maximum period of 5 years from the date of acceptance of these General Terms and Conditions of Sale. In any event, it is understood that the Customer and the Guests :
- may revoke the above authorisations by indicating this in writing to the Campsite reception during their stay;
- after publication of the Images concerning them on the social networks, may request their deletion by sending an e-mail to the following address: contact@camping-le-perigord.com
- will not receive any remuneration for the dissemination of the Images as provided for in this Article 15.

Article 16. Applicable law, jurisdiction and mediation
These General Terms and Conditions of Sale are governed by French law and any dispute relating to their application falls within the jurisdiction of the Courts of Toulon, regardless of the Customer's country of origin. In the event of a complaint, and after having referred the matter to the Campsite's Customer Service department in accordance with the Complaints procedure, the Customer may refer the matter to a consumer ombudsman, within a maximum period of one year from the date of the written complaint, by registered letter to the operator. The contact details of the mediator who may be contacted by the Customer are as follows: CMAP (Centre de Médiation et d'Arbitrage de Paris - Paris Mediation and Arbitration Centre) www.cmap.fr In application of the provisions of article 1368 of the French Civil Code, it is expressly agreed that the data stored in the information system of the Company and/or its partners have evidential value. Accordingly, the data on computer or electronic media stored in this way, if produced as evidence by the Company in any litigation or other proceedings, will be admissible, valid and enforceable between the parties.

Article 17. Partial non-validation of the General Terms and Conditions of Sale
In the event that one of the clauses of these General Terms and Conditions of Sale should become null and void as a result of a change in legislation, regulations or a court ruling, this shall in no way affect the validity of and compliance with these General Terms and Conditions.
