CONDITIONS GÉNÉRALES DE VENTES CAMPING PARADIS

ARTICLE 1: PURPOSE
These general terms and conditions define the respective obligations of the company, a member of the Camping Paradis network, a SAS company registered with the Paris RCS under Siret 79385312800197, represented by its general manager Olivier LACHENAUD (hereinafter referred to as the Camping), and the client (hereinafter referred to as the Client(s)) in the context of the sale of stays by the Camping through the website (hereinafter referred to as the Website) or any other sales platform made available to Clients.
The Company has a Civil Liability Insurance contract with Gan Assurances – a French insurance and reinsurance company – a public limited company with a capital of €216,033,700, registered with RCS Paris 542 063 797, APE: 6512Z, headquartered at 8-10 rue d'Astorg, 75008 Paris. The company is governed by the Insurance Code and supervised by the Prudential Supervision and Resolution Authority (ACPR) – 4 Place de Budapest CS 92459 75436 Paris Cedex 09, under contract number 313482522000, covering it for damages caused to third parties during the exercise of its professional activities.
In addition to these general terms and conditions of sale (hereinafter referred to as the GTC), the Client must refer to the general terms and conditions of sale specific to the Camping as well as its internal regulations (hereinafter referred to as the Internal Regulations).
The purpose of these GTC is to define the rights and obligations of the parties concerning the rental of camping pitches (hereinafter referred to as Pitch(es)) and/or rental accommodations (hereinafter referred to as Accommodation(s)) within the Camping.

ARTICLE 2: ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS AND INTERNAL REGULATIONS
By reserving a Pitch and/or Accommodation within the Camping, the Client acknowledges having fully read and unreservedly accepted the GTC.
For online reservations, this acceptance is formalized by checking the box associated with the following statement: I acknowledge having read the General Terms and Conditions of Sale. This acceptance method has the same legal value as a handwritten signature from the Client.
For reservations made via other channels (telephone or on-site), the Client acknowledges having received the link to the GTC along with their booking documents and having accepted them. These GTC remain accessible and downloadable from the Website.
The Client agrees to review the Internal Regulations of the Camping and comply with them.

ARTICLE 3 : RESERVATION

➔ Reservation Conditions
Reservations can only be validated by a person of legal age with the necessary legal capacity.
The Client commits to booking a stay in their name and on their behalf, and to occupying the selected Accommodation or Pitch during the stay.
Minors must be accompanied by their parents or legal guardians.
➔ Reservation Modalities:
Reservations can be made as follows:
By telephone.
Via the Website. A stay reservation can only be recorded if the Client is identified and has created an account.
The reservation is subject to the following conditions:
A deposit of 30% of the stay price + administrative fees + cancellation insurance (if subscribed) (hereinafter referred to as the Deposit). The balance of the stay must be paid thirty [30] days before the Client's arrival or forty-five [45] days before arrival if booked via the website www.veepee.fr (hereinafter referred to as Veepee). No discount will be granted for late arrival or early departure.
Any reservation made less than 30 days before arrival must be paid in full via bank transfer or credit card

➔ Stay Participants

Group Reservations
Each participant, regardless of age, is counted as one occupant under capacity rules, including babies and young children.
Any reservation of more than three [3] accommodations by the same individual or by different individuals known to each other and traveling together on the same dates at the same Camping is considered a group. The accommodations available on the Website are exclusively for individual customers. For group reservations, you must contact the Camping via email. The Camping reserves the right to review the group reservation request before accepting or rejecting it.
Minors
For safety reasons, minors unaccompanied by their legal guardians for the entire duration of their stay are not allowed in the Campings.
➔ Absence of Withdrawal Right
According to Article L. 221-28 12° of the Consumer Code, the right of withdrawal does not apply to accommodation, transport, catering, and leisure services provided on a specific date or period.
Therefore, the 14-day withdrawal period does not apply to the reservation of Accommodation or Pitches.
➔ Maximum Capacity
For safety and assurance, it is imperative to respect the maximum capacity allowed for each reserved Accommodation or Pitch.
If, upon arrival, it is found that the number of occupants exceeds the maximum capacity, the Camping reserves the right to deny access without any refund for the reserved stay.


The Campsite offers the rental of Pitches and Accommodations within its premises.
Bare Pitch
This is a bare pitch intended to accommodate the Client's tent, caravan, or motorhome.
The Client's stay price is calculated based on a basic package for 1 to 2 people, with additional costs determined by the number of participants (hereinafter referred to as the Rate).
The maximum capacity is 6 people.
The Rate includes the rental of the Pitch where the Client may set up, but not cumulatively:
One tent + one vehicle,
OR
One caravan + one vehicle,
OR
One motorhome.
The Rate also includes access to reception facilities, entertainment, and sanitary facilities, and depending on the chosen package, an electrical connection or other options.
Additional fees (extra person, extra vehicle, pets, etc.) are not included in the Rate and will be added to it.
The reservation of a campsite pitch is strictly personal. Under no circumstances may you sublet or transfer your reservation without prior consent from the Campsite. Minors must be accompanied by their parents or legal guardians.
The contracting party must be at least 18 years old, legally competent to enter into a contract, and not under guardianship or conservatorship. The contracting party must be present for the entire duration of the stay.
The reservation is only effective with the Campsite's agreement, after receipt of the deposit, and after receiving either a confirmation email or acceptance of the general terms and conditions during online booking.
Rental Accommodations (RML and HLL)
The reservation of an Accommodation is strictly personal. Under no circumstances may you sublet or transfer your reservation without prior consent from the Campsite.
The stay price includes the rental of the Accommodation according to the number of people (within the recommended capacity and in accordance with the maximum capacity of the Accommodation), parking for one vehicle, and access to reception facilities and entertainment.
Depending on the type of Accommodation chosen, additional fees for extra persons, extra vehicles, pets, energy tax, electric or hybrid vehicle recharging at specific dedicated charging stations, or other options are not included in the price and will be added to it. The rates for these additional fees can be obtained from the Campsite.
The basic package accommodates 1 to 8 people (including babies) depending on the type of Accommodation.
The Campsite reserves the right to deny access to groups or families arriving with a number of participants exceeding the capacity of the rented Accommodation.

ARTICLE 5: RATES, TOURIST TAX & ECO-CONTRIBUTION
Common Provisions
The applicable price will be determined according to the rate in effect at the time of booking.
Prices are quoted in euros (€), inclusive of all taxes (TTC), and do not include the tourist tax, local taxes, or possible supplements. Any changes or modifications to the applicable tax rates, as well as any changes to applicable taxes at the time of invoicing, may be reflected in the stay price. The Campsite reserves the right to adjust its rates in the event of changes to tax rates or VAT (10%).
Regardless of the chosen option (Pitch or Accommodation), additional fees may apply for extra persons, extra vehicles, extra tents, pets, or visitors.
Dynamic Pricing
The Campsite applies dynamic pricing (price adjustments based on demand variation). Consequently, prices may fluctuate upward or downward.
Thus, it is possible for Clients to have paid different prices for the same stay. Clients who have paid the highest price cannot, under any circumstances, claim reimbursement for the difference between their applicable price and the promotional or lower price that another client may have benefited from due to dynamic pricing.
Tourist Tax
A tourist tax, collected for the Municipality, must be paid upon the Client's arrival, per night and per person over 18 years old.
Eco-Contribution
An eco-contribution must be paid upon the Client's arrival, per night and per person. The Campsite is subject to taxes for the extraction of natural resources (clean water) and waste treatment (wastewater, household waste, etc.). This is a budgetary repercussion aimed at compensation and awareness (€0.45/person/night).



ARTICLE 6: PAYMENT TERMS
Accepted Payment Methods
Reservations made less than 30 days before the start date of the stay must be paid by credit card or ANCV Connect holiday vouchers.
The deposit must be paid by credit card or ANCV Connect holiday vouchers.
For the balance payment, the Client may use the following methods:
By credit card (Carte Bleue, VISA, or Mastercard) online on the Website (secure payment);
The Client's credit card information is fully protected and SSL encrypted via the secure payment platform Paybox. The Campsite will in no way have access to the Client's card number except to process the payment.
By ANCV Connect.
Default on Payment
If payment deadlines are not met, the Campsite reserves the right to recover the amounts due by any means. Furthermore, failure to pay the balance within the specified time will result in the cancellation of the reservation.

ARTICLE 7: STAY
Key Collection
Arrival and departure times are specified in the conditions available on your voucher.
Accommodation or Pitch
Any complaints about the cleanliness and/or general condition of the Pitch and/or Accommodation must be submitted in writing no later than 24 hours after arrival to allow for resolution. Complaints made after this 24-hour period will not be accepted.
The Client must return the Accommodation and/or Pitch in good condition and clean upon departure; cleaning must be done by the Client. If this obligation is not met, the Campsite reserves the right to charge for cleaning and restoration costs as per the deposit provisions [Article 7].
Choice of Accommodation/Pitch Location on the Campsite
The Client's preferences for a specific Pitch or Accommodation within the Campsite are non-binding. Such requests will be considered based on availability and reception capacity upon the Client's arrival.
Late Arrival and Early Departure
If the Client arrives later or departs earlier than the dates indicated on the reservation confirmation, the Client must inform the Campsite.
No price reduction or refund will be granted for the unused portion of the stay.
Security Deposit
A security deposit, the amount of which is defined in the conditions available on the Website, will be requested from the Client prior to arrival (indicatively between one week and one month before the arrival date) or, if applicable, at the Campsite reception. This deposit will be refunded at the end of the stay and/or within eight days after departure, provided the Accommodation/Pitch is returned in good and clean condition.
The Campsite reserves the right to retain all or part of the deposit in case of damage to the Accommodation, Pitch, and/or their contents or any equipment on the Campsite.
The Campsite may also deduct the cost of missing items and/or cleaning fees if the departure cleaning has not been adequately performed, after notifying the Client in advance.
Cleaning/Final Cleaning
At the time of departure, the Accommodation and/or Pitch must be left in an appropriately clean state (floors cleaned, dishes washed, trash emptied, cupboards cleaned, kitchen and bathrooms/WC cleaned). Any anomalies noticed upon arrival must be reported in writing to the Campsite within 24 hours so that immediate action can be taken. Failure to report anomalies within this timeframe will prevent favorable consideration of complaints.
If the obligation to return the Accommodation and/or Pitch in good and clean condition at the end of the stay is not met, the Campsite reserves the right to charge the Client cleaning fees, which will be deducted from the deposit, after prior notice.
Optional Cleaning Service
The Client can opt for an end-of-stay cleaning service for an additional charge. The cost of this service depends on the category of Accommodation. However, choosing this option does not exempt the Client from basic cleaning duties such as disposing of trash, washing dishes, and tidying up blankets to respect the Campsite's cleaning staff.
Other types of deposits: In some Campsites, a deposit may also be required for items such as barbecue rentals, bicycle rentals, access badges for barrier use, or other specific services.
Pets
Pets (excluding first and second-category dogs) are welcome at certain Campsites for an additional fee, payable upon reservation. When permitted, pets must always be kept on a leash. They are prohibited near swimming pools, in food shops, and in reception, entertainment, and sanitary buildings. Vaccination records for dogs and cats must be up to date.
Specific pet policies are detailed in the conditions applicable to each Campsite on the Website.
Visitors
Visitors are allowed on the Campsite premises after registering at reception and paying a visitor fee.
Visitors may access Campsite facilities, except for aquatic areas.
Internal Rules
The Client agrees to familiarize themselves with the Campsite's Internal Rules before arrival and acknowledges that these Rules govern their stay in addition to the Terms and Conditions. During the stay, the Client must adhere to the Internal Rules and ensure compliance by their companions and visitors, who are under their responsibility.
In the event of non-compliance with the Internal Rules, the Campsite has the authority to enforce them and apply necessary sanctions, up to and including expulsion from the Campsite without refund.
Rehousing
If, due to exceptional circumstances, the reserved Accommodation or Pitch cannot be made available, the Campsite may offer the Client alternative accommodation of equivalent type and category.
Liability
In accordance with applicable law (Article 1952 of the French Civil Code), the sale of tourist stays is not subject to hotel liability.
Therefore, the Campsite is not liable for loss, theft, or damage to personal belongings, including in the Accommodation, on the Pitch, in common areas, or parking lots.
The Client is responsible for securing their Accommodation/Pitch during their stay. Precautions, such as locking doors and windows, should be taken to avoid potential issues.
Image Rights
The Campsite may take photos or videos on its premises for promotional or communication purposes, in which the Client and their companions may appear. By accepting the Terms and Conditions, the Client is presumed to authorize the Campsite to use such images. Any specific refusal must be submitted in writing.
The Client or their companions may request the removal of identifiable images at any time by submitting a written request to the Campsite.
Service Unavailability
Services and facilities (pool, restaurant, activities, etc.) may not be available year-round due to weather, force majeure, or seasonal limitations. No refunds or price reductions will be granted for such service interruptions.


➢ Termination of the Reservation Contract Due to Client Violation
The reservation contract will be automatically terminated at the Client's fault in the following situations:
If the Client does not check in at the campsite within 24 hours of the start of their stay without providing justification or notification of their late arrival. The campsite will then consider the Client to have forfeited their accommodation after this 24-hour period. Any payments made will be retained, and no refunds will be issued.
In the event of repeated violations, meaning if the Client or their companions breach the rules after receiving a warning email requesting compliance with the Internal Regulations, the campsite reserves the right to terminate the stay contract with immediate effect. In such cases, the Client will be required to vacate their accommodation and/or pitch within three hours of being notified of the contract termination via email. No refunds will be issued by the campsite. Specifically, the campsite declines any liability in the event of a Client being excluded from the campsite for failure to comply with the Internal Regulations.

ARTICLE 8: STAY MODIFICATIONS OR CANCELLATIONS
➢ Modifications or Cancellations by the Client
It is noted that the Client does not benefit from a right of withdrawal in accordance with Article L221-28-12 of the French Consumer Code.
Cancellation or modification of the stay will result in the following charges being applied by the campsite:
More than 30 days before the start of the stay:
30% of the stay price + booking fees + insurance fees (if purchased).
From 30 days to less than 30 days before the start of the stay:
100% of the stay price + booking fees + insurance fees (if purchased).
Changes to the dates or content of the stay are considered a cancellation, with charges applied according to the above schedule.
For any other modification request, subject to feasibility, an administrative fee of twenty-five euros (€25) will be applied.
➢ Modifications or Cancellations by the Campsite
In the event that the campsite cancels the Client's stay for a reason unrelated to force majeure (as defined by established jurisprudence), the campsite will notify the Client as soon as possible by email.
The campsite will make its best efforts to propose an alternative solution to the Client.
If no suitable alternative is agreed upon, the amounts paid will be fully refunded within 72 hours.

ARTICLE 9: CANCELLATION INSURANCE
The stay price does not include cancellation insurance. Such insurance is optional and offered during the booking process (insurance provided by NEAT Camping, covering the Client under certain conditions before departure and during their stay).
The corresponding amount must be paid in full at the time of booking.
The insurance offered includes the following options:
FLEX Insurance: Cancellation with or without justification for any unforeseen event outside the Client's control preventing their trip.
Reimbursement WITH Justification: 100% reimbursement of cancellation fees (minus applicable deductibles).
Reimbursement WITHOUT Justification: 70% reimbursement of cancellation fees (minus applicable deductibles).
Clients should verify with their current insurance policies that they have vacation rental coverage under their home insurance contracts and review its conditions. If such coverage is not in place, Clients are required to insure themselves against risks inherent in their rental, such as accidents, death, theft, loss, or damage to personal belongings (suitcases, valuables, vehicles, bicycles, etc.). Clients must also insure themselves for damages caused to the rental property or campsite by themselves or their companions. Proof of insurance may be required at any time. For bicycle rentals or loans, Clients are required to insure against theft, loss, or damage.

ARTICLE 11: CLAIMS AND DISPUTES
Any Client complaint concerning issues encountered during their stay must be submitted precisely by registered letter with acknowledgment of receipt to the campsite no later than twenty (20) days after the end of the stay. The letter should be sent to the following address: Camping Paradis or via email to reclamation@alphacamping.fr.
A copy of the complaint can also be sent to the campsite by the Client.
If no agreement is reached between the Client and the campsite regarding the complaint, and if the Client submitted their written complaint to the campsite less than one year prior, the Client may refer the matter to the Tourism and Travel Mediation Service provided by the campsite.
The Client can submit their mediation request to the Tourism and Travel Mediation Service electronically at: https://www.mtv.travel/.
Mediation is free of charge, except for legal fees, expert fees, or other costs associated with third parties engaged by the Client.
The European Commission has also established an online dispute resolution platform to facilitate consumer complaints related to online purchases. This platform can be accessed here: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=FR.
ARTICLE 12: APPLICABLE LAW AND COMPETENT JURISDICTION
The Terms and Conditions of Sale (TCS) are governed by French law.
The TCS are drafted in French and may be translated into other languages for informational purposes. In case of dispute, only the French text will prevail.
If any clause of the TCS is deemed invalid, this will not affect the validity or enforceability of the remaining clauses, which will remain fully applicable.
Any disputes or disagreements related to the TCS, whether regarding their validity, interpretation, execution, or termination, will be brought before French courts, regardless of the Client's country of origin, unless otherwise stipulated by public policy provisions.

ARTICLE 13: PERSONAL DATA
The personal data processing carried out by the campsite for reservation purposes is governed by the Camping Paradis Personal Data Protection Policy, available on the website.

ARTICLE 14: OPT-OUT FROM TELEPHONE SOLICITATION
In accordance with Articles L.223-1 and following of the French Consumer Code, if the Client does not wish to be solicited by telephone on the number they provided to the campsite, they may register this number on the telephone opt-out list at any time via the website www.bloctel.gouv.fr or by mail to the following address: Société Opposetel, Service Bloctel, 6 rue Nicolas Siret, 10000 Troyes.
