Article 1 : Application, opposability of the general conditions of use and rental
The present general conditions of rental applies to the whole of the rentals concluded by the company NJP PARISOT, with consumers and non-professional buyers (The Customers or the Customer), wishing to rent a camping site, a mobile home proposed to the rental by means of the placing of an order on paper or through the Internet site https://www.hermitagedesdunes.com.
In accordance with the regulations in effect, the present general conditions and the information appearing on the site comply with the legal regulations on pre-contractual information provided to the Customer.
They specify in particular the conditions of reservation, of payment carried out by the Customers.
Reservations can only be made by clients of legal age who have the full contractual capacity.
The camping is located in an area subject to natural risk (risk of flooding), the customer is informed by means of a notice of the warning and evacuation devices provided within the camping.
Article 2 : Reservation
2.1 Reservation procedure
The Customer reserves his rental according to the process in place on the Website and confirms the recapitulation of the reservation. In order to make a reservation on the website, the Customer must fill in a form, all fields of which are mandatory.
He/she must select the desired accommodation(s) and/or campsite(s) and, if applicable, the chosen options which are visible in the Summary/Booking section.
In addition, the Customer must inform the number of persons who will be present and indicate the names and surnames, date of birth, of these persons in order to determine the amount of the tourist tax applicable to adults.
The reservation will be the subject of a recapitulation called Recapitulation/Reservation including all the elements of the reservation, in particular the accommodation(s) or the pitch, its description, its equipment, the start and end date of the rental, quantities, the options chosen, the method of payment, the amount including all taxes of the reservation, the amount of the deposit to be paid and the balance due. The price is determined according to the information communicated by the Customer. On the day of the arrival, NJP PARISOT reserves the right to charge any supplement which would not have been specified by the Customer at the time of the reservation, in particular the number of persons present on the site, the presence of a dog, etc.
The Client may return to his reservation, complete it, modify it or cancel it as long as he has not validated it. The Client will validate this reservation by clicking on Validation after having read and accepted the present general conditions of use and rental. Without acceptance, the Client will not be able to finalize his reservation.
Any reservation signed by the validation click constitutes a firm and irrevocable commitment by the Client.
Any reservation validated on the Website implies an obligation of payment of the deposit by the Client.
2.2 Booking confirmation
The Customer will receive by e-mail from the company NJP PARISOT, an e-mail confirming the reservation after the payment, which recapitulates the reservation made by him/her and the corresponding invoice (address of the Customer, reserved Product(s), price, method of payment, date of beginning and end of the renting, as well as all the information relative to the renting). This booking confirmation will serve as proof and must be presented on the day of arrival to take possession of the accommodation. The price is determined according to the elements provided by the Customer.
The data recorded by NJP PARISOT constitute the proof of all the reservations and financial transactions passed between NJP PARISOT and its customers. The amount due by the Customer is the amount indicated on the confirmation of reservation transmitted by e-mail by NJP PARISOT to the Customer. In any case, NJP PARISOT reserves the right to refuse any reservation in case of total or partial non-payment of a previous reservation by the Customer, of refusal of authorization of payment by credit card or by check of the banking organizations, of non-payment or partial payment, or of a Customer having been the object of an exclusion of the camping for non respect of the internal rules.
Article 3 : Capacity and availability of the accommodations
3.1 NJP PARISOT reserves the right to refuse any reservation which would not be in adequacy with the capacities of reception and accommodation offered.
For the accommodations (mobile-home), the maximum number of persons is specified in the description of the chosen accommodation.
For the pitches, the maximum number of people allowed is eight per pitch.
3.2 The offers of accommodation and prices are valid as long as they are visible on the Website within the limit of availability. In case of unavailability of an accommodation ordered and paid, the Customer will be informed. If no alternative solution is found and accepted by the parties, the refund will be made.
For reasons of safety and insurance, it is forbidden to exceed the number of occupants expected by pitch or by type of accommodation (babies and children being considered as one occupant). NJP PARISOT will refuse any person beyond the capacity planned for the rented accommodation.
Article 4 : Duration of the rental / arrival and departure time
4.1 The arrivals for the accommodations and pitches of the camping are done on the day of the beginning of the renting from 3 p.m. to 7 p.m., except for the period of July and August where the arrivals must be done from 4 p.m. to 7 p.m. In case of late arrival, the Customer is held to warn NJP PARISOT at the latest the day before the arrival.
For arrivals, the Client must bring the reservation confirmation.
For the departures, the Customer is held to release the day of departure, the camping site between 9 am and 12 am and the accommodation between 8 am and 10 am.
4.2 An inventory is made in the presence of the Client upon return of the keys in order to check that the equipment is in working order and that the accommodation is the exact same conditions.
Article 5 : Rules of the camping
5.1 The Customer is required to read the camping's rules and regulations available at the following link xxxxxx and to respect its terms. The Customer undertakes to ensure that the rules of the camping are respected by the persons accompanying him. Any violation of these rules as well as of the present conditions may result in expulsion. Any violent behavior, insulting, racist or threatening remarks made against other customers or staff will not be tolerated and will result in immediate expulsion. In this case, no refund will be given.
5.2 The Customer is considered as the only and unique guardian of his personal belongings. NJP PARISOT will not be held responsible, during all the duration of the stay of the Customer, for the losses, thefts of personal belongings of the Customer.
5.3 Dogs and cats are accepted, with the exception of dogs of 1st and 2nd categories according to the legislation in force in the camping. Only one animal is accepted for each rental. Dogs are subject to an additional charge.
5.4 Minors who are not accompanied by their parents must have an authorization from one of their legal representatives in order to be accepted on the camping site.
In any case, the minors remain, inside the enclosure of the camping under the only and unique authority of their legal representative or the adult accompanying them.
5.5 It is the responsibility of the Customer to verify that he/she has an insurance covering damages caused by fire or explosion outside his/her home, and not excluding the practice of camping.
5.6 Some comprehensive home insurance policies cover damage to camping equipment and personal belongings, for a limited amount. It is the Customer's responsibility to check that the out-of-home furniture guarantee applies to the camping. If the Customer is not covered or is insufficiently covered, he/she can ask his/her insurer for an extension of the guarantee.
5.7 The Customer acknowledges that he/she is solely responsible for his/her personal belongings. He must take all the necessary measures to avoid the theft. For this reason, NJP PARISOT invites the Customer to lock the accommodation.
Article 6 : Prices
6.1 The Products are provided at the rates in current appearing on the Website. The prices are expressed in euros and all taxes included.
The reservation includes the amount of the Product(s) reserved in accordance with the price listed on the Website.
6.2 The prices do not include tourist tax, additional options such as an extra car (or trailer), parking, a dog (accepted depending on the camping), sheets, a baby kit, an extra tent, payable activities proposed by the camping, bicycle rental, household expenses, transport or consumption expenses etc.
6.3 These costs must be paid on arrival at the camping.
6.4 Additional services resulting from a voluntary extension of the stay (early arrival, climatic conditions, etc.) are to be paid for by the Client on the basis of the current price list.
6.5 Tourist taxes are collected on behalf of the municipalities and are not included in the price of the stay. They must be paid on the spot on the day of arrival according to the number of people staying in the rental.
Article 7 : Payment
7.1 Any reservation made with NJP PARISOT supposes the payment of a deposit on the price of the rental corresponding to 25 % of the total price including all taxes of the rental.
The payments carried out via the Website are made only by credit/debit card.
The payment of the deposit is made at the time of the validation of the reservation.
7.2 The customer will pay the balance upon arrival at the camping. Payments can be made by bank check, credit card, ANCV checks, cash for any amount less than 1000 euros.
7.3 For the security of the payments by credit/debit card, the banking data are encrypted and transmitted in a completely protected environment to the financial partner of NJP PARISOT, the bank PAYLINE.
Article 8 : Cancellation - Interruption of the stay - Modification of the rental
8.1 Any request of modification of your reservation will have to be addressed at least 30 days before the initial date of the beginning of the stay, in writing to the following address : l'HERMITAGE DES DUNES, rue du Bois Millet, 44760 Les Moutiers en Retz or by e-mail : hermitagedesdunes@gmail.com
The modifications of date concern only the current season. No postponement to the next season will be accepted.
The modifications of date can be taken into account only subject to the availability of the accommodations. Changes may result in a modification of the initial rate.
Any request of modification made less than 30 days before the beginning of the stay will be rejected by right.
In case of rejection of the modification of dates, the Customer will have to carry out his rental under the initial conditions or cancel it.
8.2 Any stay started is due in full. No compensation will be granted in case of delayed arrival or early departure.
8.3 If the modification of the stay before its beginning is due to the company NJP PARISOT, the Customer can :
- accept to take part in the modified stay (dates, place of stay and/or type of accommodation). In the case of an overcost on the price of the accommodation, NJP PARISOT commits itself to take charge of the price difference. In the case of a decrease of the cost NJP PARISOT commits itself to refund the Customer of the difference of price.
- If the Client cancels his stay, NJP PARISOT will then refund the whole amount paid (booking fees and cancellation insurance included).
8.4 In case of cancellation of the rental by the Customer, NJP PARISOT will not proceed to any refund. In other words, NJP PARISOT will keep the entirety of the deposit paid at the time of the reservation.
8.5 In case of cancellation of the rental by NJP PARISOT, the deposit paid by the Customer will be refunded , excluding any other compensation.
Article 9 : Responsibility
9.1 NJP PARISOT will not be responsible in case of modification, cancellation or other events due to cases of force majeure in the sense of the article 1218 of the civil code, because of the Customer or because of a third party unrelated to the provided services.
9.2 NJP PARISOT will not accept any complaint and any refund, relating to any non-performance or bad execution of the service which is provided, imputable either to the customer, or to the fact of a third party unrelated to the service, or to any case of force majeure.
In case of force majeure or fortuitous events, NJP PARISOT, cannot be held responsible for the nuisances which would come to disturb, to interrupt or to prevent the stay (drought, flood, fire, black tide, general cut of electricity, gas, water, strike, work...) which can take place in the neighbourhoods of your place of stay.
The Customer informed of these possible nuisances with the only condition that NJP PARISOT was informed.
9.3 NJP PARISOT will not incur any responsibility for any indirect damage due to the present, operating loss, loss of profit, loss of chance, damage or expenses.
Article 10 : Warning
NJP PARISOT makes a commitment to assure the functioning of the site in order to allow an optimal use in the conditions defined in the present general conditions.
The Customer declares to be informed of the unreliability of the Internet network, particularly :
- On the security of data transmission,
- On the obligation to protect its material or its computer network with an anti-virus regularly updated,
- On the non-guaranteed performances in terms of volume and speed of data transmission,
- On the fact that the continuity of access to the service is not guaranteed.
The service can be occasionally suspended because of interventions of maintenance necessary to the good functioning of the site.
NJP PARISOT would not be held responsible in case of dysfunction of the site because of maintenance, technical problems, impossibility to reach the site and breakdowns of the server of hosting.

Article 12 : Applicable law - Attribution of jurisdiction
The present general conditions of use and rental are subject to French law.
In case of dispute, the Customer must address in priority to the customer service of NJP PARISOT to the mail l'HERMITAGE DES DUNES, rue du Bois Millet, 44760 Les Moutiers en Retz or by e-mail : hermitagedesdunes@gmail.com
In the absence of agreement, the disputes to which the operations concluded in application of the present general conditions of rental could give place, concerning the validity, their interpretation, their execution, their cancellation, their consequences and their continuations and which would not have been able to be solved between NJP PARISOT and the Customer will be subjected to the competent courts according to the provisions of common law.
The Client is informed that he can in any case have recourse to a conventional mediation, in particular with the association MEDYCIS Centre of mediation and amicable settlement of the judicial officers. Any request for mediation must be formulated to him, on by electronic way, www.medicys.fr, or by postal way: MEDICYS, 73 Boulevard de Clichy - 75009 Paris, or to any other alternative mode of settlement.
Article 13 : Right of withdrawal
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to the purchase of accommodation services (hotel, camping...), transport (people, goods, moving), car rental, catering or leisure activities provided at a specific date or according to a specific period (show ticket...).
