1- SCOPE OF THE GENERAL TERMS AND CONDITIONS OF SALE

These general terms and conditions automatically govern all sales of holidays made by Camping La Tour De France or on the www.campinglatourdefrance.fr website. They form an integral part of any contract concluded between the campsite and its customers.
In order to benefit fully from the services offered by Camping La Tour De France, we advise you to read carefully the general conditions below which govern the sale of holidays. Booking a holiday implies full acceptance of these terms and conditions.

2- BOOKING CONDITIONS

A.The reservation only becomes effective after receipt of the deposit (30% of the total cost of the stay). As long as the deposit has not been paid, the reservation is under option. The option only lasts for 15 days, after which time the campsite reserves the right to cancel it if it is not confirmed by the deposit.
B.Reservations are only binding on the Campsite if the Campsite has accepted them, which the Campsite is free to do or refuse depending on availability and, in general, on any circumstances likely to affect the execution of the reservation made.
C.The campsite offers family holidays in the traditional sense, with accommodation specially designed for this purpose. The campsite reserves the right to refuse any booking which is contrary to this principle or which seeks to deviate from it.
D.Reservations for camping pitches or accommodation are made on a strictly personal basis: only the persons named on the contract will be admitted to the pitch or accommodation.
E.Minors must be accompanied by their parents or legal guardians.
F.The pitch number is never contractual and is allocated subject to availability. It is never communicated in advance, and the choice may be left to the customer if he pays the pitch preference fee (15€ or 25€).

3- SERVICES

1. CAMPING PITCHES :
Our pitches vary in size. They can accommodate from 1 to 6 people. Depending on the type and size of your equipment, we will assign you a pitch. Please call us to discuss your requirements.
The basic rate is all-inclusive and includes a pitch for 1 piece of equipment (caravans, motorhomes) or several pieces of equipment (tents), for 2 people, for 1 electricity connection, access to sanitary facilities and reception facilities. It is not possible to place several campervans and caravans on a single pitch.

2. RENTAL:
Rental accommodation is equipped (furniture, crockery), with or without sanitary facilities. Rental includes water, gas and electricity consumption and the number of people may not exceed the accommodation's capacity. Sheets, household linen and end-of-stay cleaning are not included in the basic price.

3. GROUP RESERVATIONS
The Campsite reserves the right to refuse access to the Campsite to families or groups who arrive with a number of participants greater than the capacity of the accommodation rented. A group is considered to be: any family or group of individuals who know each other and who travel together, booking under the same person or individually, more than 2 accommodations or pitches on the same or overlapping dates of stay and for the same reasons. All requests for group bookings must be made in advance to the campsite, which reserves the right to accept or refuse such bookings.

4- RATES

Prices are subject to change. The campsite reserves the right to change prices at any time. The rate applicable to the stay is the rate in force on the day of booking, subject to availability. When the customer requests a quote, its validity is indicated on the document. Once the validity date has passed, the price indicated is no longer guaranteed.
Any benefits or promotions offered by the campsite after the booking date cannot be applied to a booking that has already been paid for in full or in part.
Prices are quoted in euros (including VAT at the current rate) and are per night, with a minimum number of nights depending on the period.
A booking fee will be charged for all telephone or email bookings of pitches or accommodation, whatever the duration. The amount is fixed and non-refundable.

5- TOURIST TAX

Tourist tax is compulsory and the amount is set by decision of the Fenouillèdes Community of Communes. It applies to people over the age of 18 and must be paid no later than the day of your arrival.

6- NO RIGHT OF WITHDRAWAL

The legal provisions relating to the right of withdrawal in the case of distance selling as set out in the Consumer Code do not apply to tourist services (article L.121-19 of the Consumer Code).
Therefore, for any order for a stay with the campsite, the customer has no right of withdrawal.

7- TERMS OF PAYMENT

For bookings made more than 30 days before the date of arrival, a deposit of 30% of the price of the services booked must be paid at the time of booking.
The balance of your booking must be paid no later than 30 days before your arrival.
For bookings made less than 30 days before the date of arrival, the full amount of the stay must be paid.
You will be charged for the period booked as indicated on the contract. No reductions will be made for late arrivals or early departures.

8- CHANGING YOUR BOOKING

The customer may request, free of charge, changes to their holiday, dates or type of accommodation, more than 30 days before the date initially planned, by written request either by post or by e-mail. These changes may be accepted or refused by the campsite depending on availability. No postponements will be accepted for the following season. If no change is made, the customer will have to make his stay under the initial booking conditions or cancel it in accordance with the cancellation conditions.
Any increase in the length of stay will be subject to availability and the current rates.
Any request to reduce the length of your stay will be considered as a partial cancellation and will be subject to the cancellation and interruption of stay conditions.

9- SERVICES NOT USED

In the event of early departure, late arrival or partial cancellation, the dates of the stay indicated on the booking confirmation will be invoiced. After 24 hours without any news from you, the Management will dispose of the Mobile Home or pitch covered by the contract.

10- CANCELLATION

A.CANCELLATION BY THE CAMPSITE :
In the event of cancellation by the campsite, except in cases of force majeure, the stay will be reimbursed, up to the amount of payments received on the date of cancellation. This cancellation may not, however, give rise to the payment of damages.
Any reservation not paid for within the time allowed, in accordance with the general terms and conditions of sale, will be cancelled.

B.CANCELLATION BY THE CUSTOMER
Case 1: Cancellation more than 30 days before the arrival date :
The sums paid will be refunded, less a non-refundable administration fee (€10).
Case 2: Cancellation between 30 days and 15 days before the arrival date
The deposit paid will be retained by the campsite as a cancellation fee, less non-refundable administration costs.
Case 3: Cancellation less than 15 days before the arrival date
Less than 15 days before the arrival date or if you do not show up on this date: the total amount of your stay (whether paid or not) will be retained as a cancellation fee.

CANCELLATION GUARANTEE to be taken out promptly and before 30 days of arrival

To ensure that your holiday is covered right up to your arrival date and that you can leave on holiday with peace of mind, we advise you to take out our cancellation guarantee.
The amounts paid for the reservation (deposit and balance) can be covered by the cancellation guarantee offered by S.A.S MML (Camping LA TOUR DE FRANCE).
The cost of this guarantee is €3.5% of the amount of your booked stay, with a minimum of €5 for short stays.
The guarantee entitles you to a refund if one of the events listed below occurs before your arrival and not during your stay. You will be reimbursed the amount(s) paid, less the cost of the cancellation guarantee and a €10 handling fee, on presentation of official proof.


REASONS :
- Serious illness, serious accident or death of a member of your family: ascendants, descendants or those of your spouse, sons-in-law and daughters-in-law, brothers, sisters, brothers-in-law, sisters-in-law.
- Pregnancy complications before the 7th month
- Significant material damage to your own property requiring your presence.
- Redundancy
- Accident to or total theft of your vehicle and/or caravan occurring on the direct route to your holiday destination
- Cancellation or change of holiday dates by your employer.

Your obligations in the event of an event forcing you to cancel your holiday:
From the first sign of illness or knowledge of the event giving rise to the guarantee, you MUST notify the campsite management within 24 hours.


Provide all the documents required for your declaration by registered letter with acknowledgement of receipt, i.e. :
- a medical certificate stating the nature, origin and seriousness of the accident or illness.
- a death notice
- any proof of the event.


If you do not subscribe to this 'Cancellation Guarantee', no reimbursement will be made and the general terms and conditions of sale will apply. Any interrupted or shortened stay (late arrival, early departure) will not give rise to a refund.
We will do our utmost to find a rapid solution to any problems that may arise.

11- PROGRESS OF THE HOLIDAY

1. ARRIVALS
In the event of an unannounced late arrival, the rental/pitch will become available 24 hours after the arrival date stated on the booking contract. After this time, and in the absence of a written message, the booking will be cancelled and the sums paid will be retained by the campsite (non-refundable).

Pitches :
Arrivals are from 3pm in high season, any day of the week and in the morning in low season (subject to availability of the chosen pitch).

Rental accommodation:
For rental accommodation, we will welcome you from 3 p.m. on the day of your arrival (Saturday, Sunday or Wednesday) in high season; in low season, customers may arrive any day of the week, at any time, subject to availability and the agreement of the campsite.

2. DURING YOUR STAY
It is the camper's responsibility to be insured. Campers are responsible for looking after their personal belongings (bicycles, mobile phones, laptops, towels, etc.) and must have third-party liability insurance for their equipment (caravan, tent, camper van, etc.).
The campsite declines all responsibility for damage to the camper's equipment that is not their own fault.
All customers must comply with the campsite rules, which will be given to you on the day of your arrival and displayed at the campsite entrance.
Each tenant is responsible for any disturbance or nuisance caused by persons staying with or visiting them. Any disturbance caused intentionally and despite the recommendations or interventions of the campsite staff may result in the immediate termination of the contract, without any right to reimbursement.

3. DEPARTURES
All administrative formalities for departure must be completed the day before at the latest. For any late departure, an additional day may be charged at the current nightly rate.

Pitches :
Pitches must be vacated by 11am on the day of departure.

Rental accommodation:
Rental accommodation must be vacated before 10am on the day of departure indicated on your contract. The accommodation must be left in a clean and tidy condition and the inventory may be checked. Any broken or damaged equipment will be charged to you, as will the restoration of the premises, should this prove necessary. The deposit of 150€ (to be given on the day of arrival) will be returned to you at the end of your stay, after deduction of any compensation deducted from the supporting invoice for any damage found in the inventory on departure. Retention of the deposit does not exclude additional compensation if the cost of repair exceeds the amount of the deposit.
If the accommodation has not been cleaned before your departure, you will be asked to pay a cleaning charge at the price corresponding to your type of accommodation.
If you are unable to be present during the inventory of fixtures (departure outside reception opening hours), once the accommodation has been checked and found to be in good condition, the deposit will be forfeited and you will be informed accordingly. You may ask for the deposit to be returned if it is by bank cheque

12- PETS

Pets (except 1st and 2nd category dogs) are welcome at an additional cost. They must be registered on arrival. They must be kept on a lead at all times, identified and have their vaccination certificate up to date, and are the responsibility of their owner. They must not be left alone on your pitch or in your accommodation.


13- AQUATIC AREA :

Access to the aquatic area is regulated. Instructions are posted at the entrance to the pool area and relayed by our staff. We would remind you that :
Swimming is not supervised. Children must be accompanied and swim under the responsibility of their parents or legal guardians. Access to the swimming pools is free and strictly reserved for campsite guests. Visitors are not allowed in the swimming pool.
Dogs and food are not allowed in the pool area.
Swimming briefs or boxer shorts, bikinis or 1-piece swimming costumes are permitted. Swimming shorts or any other swimwear are not permitted.
Staff reserve the right to refuse access to the pool in the event of inappropriate or dangerous behaviour.

14- LIABILITY OF THE CAMPSITE

The customer expressly acknowledges that the Campsite may not be held liable for the communication by its partners or by any third party of false information mentioned in guides or websites, in particular photos, descriptions, activities and facilities, leisure activities, services and dates of operation. All photos and text used on the campsite website are non-contractual. They are for information purposes only. It may happen that certain activities or facilities offered by the campsite and indicated in the description on the website or in the brochure are cancelled, particularly for climatic reasons or in the event of force majeure.

15- IMAGE RIGHTS


You authorise the campsite, or any person appointed by the campsite, to photograph, record or film you during your stay, and to use the said images, sounds, videos and recordings in any medium (in particular the website or web page, Facebook, in any promotional or presentation media and in tourist guides). This authorisation applies both to you and to persons staying with you. Its purpose is to promote and animate the Campsite and may in no way damage your reputation. This authorisation is granted free of charge for all countries and for a period of 10 years.

16- INFORMATION TECHNOLOGY AND FREEDOM

The information you give us when you place your order will not be passed on to any third party and is considered by the campsite to be confidential. It will only be used by the campsite to process your order and to improve and personalise the communication and services offered to campsite customers.
In accordance with articles 39 et seq. of law no. 78-17 of 6 January 1978, amended in 2004, relating to information technology, files and civil liberties, any person may obtain communication and, where appropriate, rectification or deletion of information concerning him or her.

17- DISPUTES

Any complaint concerning the non-conformity of the services provided in relation to the contractual commitments may be reported by post or by email to the Management of the Campsite.
Mediation: If you are not satisfied with the campsite's response, you can contact the CM2C mediation centre within one month of sending these letters or emails.
